The petitioner apprehends his arrest in Complaint Case No.2629 of 2016, registered under Sections 498A and 323 of the Indian Penal Code.

The complainant, wife of the petitioner, alleged that after her marriage with the petitioner in the year 2014, the petitioner subjected her to different sorts of torture due to nonfulfillment of demand of dowry and thereafter the petitioner ousted her from her in laws house due to non-fulfillment of demand of dowry.

Learned counsel for the petitioner submits that the petitioner is ready to keep his wife. The petitioner never

Patna High Court CR. MISC. No.68533 of 2019(2) dt.14-11-2019 2/2 demanded any dowry nor subjected his wife to torture. The wife of the petitioner does not want to live with the petitioner. Even during the pendency of the anticipatory bail petition before the learned Sessions Judge, notice was issued to the complainant and the learned counsel for the complainant was also informed but the complainant did not appear and this fact itself shows that the complainant is reluctant to restore her conjugal relation with her husband.

Taking into consideration the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Vaishali at Hazipur in connection with Complaint Case No.2629 of 2016, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
