This is the second attempt on behalf of the petitioner for grant of bail in connection with Sessions Trial No.629 of 2025, arising out of Dhaka P.S. Case No.314 of 2018 registered for the offence under section 304-B/34 of the Indian Penal Code.

Earlier, the prayer of the petitioner for grant of bail was rejected by this Court vide order dated 30.04.2025 passed in Criminal Miscellaneous No.24588 of 2025. 4.

The petitioner is the husband of the deceased. The main allegation is against the mother and sister of the petitioner to have killed the deceased.

The petitioner is in custody since 20.12.2024.

Learned counsel for the petitioner submits that in this case the trial has started but is being delayed for no fault of the petitioner. He further submits that the mother and sister of the petitioner against whom the main allegation of killing the deceased has been made, have been acquitted in the trial.

Considering the fact that the main allegation is against the mother and sister of the petitioner, who have been acquitted in the trial and the period of custody of the petitioner, this bail application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, XIV, East Champaran at Motihari / concerned Court below, in connection with Sessions Trial No.629 of 2025, arising out of Dhaka P.S. Case No.314 of 2018, subject to the condition that he will cooperate in the trial and will appear himself or through his lawyer of each and every date fixed in the trial.
