Petitioners, already in custody, seek bail in connection with Atri PS Case No.14 of 2016, registered under Sections 147, 148, 149 and 302 of the Indian Penal Code as well as under Section 27 of the Arms Act.
Allegation in brief is that 14 accused persons opened indiscriminate firing on the person of the deceased causing his death and the occurrence was committed due to dispute regarding providing labourers in the brick kiln. Learned counsel for the petitioners submits that only one firearm injury was found on the person of the deceased whereas 14 persons are said to have opened fire; the petitioners have
Patna High Court Cr.Misc. No.29185 of 2018(2) dt.11-05-2018 2/2 been implicated due to enmity and similarly situated other coaccused, Naresh Yadav, Rajnandan Yadav @ Mohan Yadav and Rakesh Yadav have been admitted to bail by co-ordinate Benches of this Court vide Cr. Misc. Nos.28530 of 2016 and 35258 of 2016 on 30.09.2016 and the petitioners have no criminal antecedent.
Having considered the aforesaid facts and circumstances, petitioners, namely, Raju Kumar @ Raju Yadav and Kapil Yadav are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Gaya in connection with Atri PS Case No.14 of 2016.
