The petitioner is accused in connection with NDPS Case No. 05 of 2019 arising out of P.R. No. 04/18-19 (Excise), registered under Section 20 (B) of the NDPS Act, 1985 pending in the Court of learned Sessions Judge, Gaya. Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case. Petitioner has no criminal antecedent. Petitioner is in custody since 21.01.2019.

Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner with submission that a large quantity of narcotic material purported to be Ganja weighing

Patna High Court CR. MISC. No.80029 of 2019(3) dt.18-01-2020 2/2 128 Kg was recovered from a Swift Dezire Car and the said vehicle was found in possession of the petitioner. Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected.
