Petitioner apprehends arrest in registered for the offences punishable under Sections 147, 341, 323, 307, 504 and 506 of the IPC read with section 27 of the Arms Act. As per the prosecution case, while the informant and others were cutting grass, in the meantime, petitioner and other accused persons came there. Some scuffle took place between the parties. Thereafter, petitioner and other accused persons started indiscriminate firing on the informant side. Firing made by the petitioner caused injury to the informant. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case because of land dispute between the parties from before. There is general and omnibus allegation against the petitioner and no specific overt act has been alleged against him.
Learned counsel for the State and the informant oppose the prayer for bail. It is submitted by Learned counsel for the informant that the petitioner is named in the FIR with
Patna High Court CR. MISC. No.3184 of 2023(2) dt.28-03-2023 2/2 specific allegation that he also fired at the informant causing him fire arms injury. In course of investigation, witnesses have also supported the prosecution case.
Considering the gravity of allegation, prayer for bail of the petitioner is refused.
