JUSTICE MOHIT KUMAR SHAH ORAL ORDER 19-09-2025 The learned counsel for the opposite parties submits that in compliance of the order of this Court dated 24.09.2019, passed in CWJC No.19829 of 2019, encroachment in question has already been removed, hence present petition has been rendered infructuous.

2. At this juncture, the learned counsel for the petitioner submits that if the encroachment in question has resurfaced, the petitioner be granted liberty to avail such remedies as are otherwise available under the law. Liberty so sought is granted.

3. The petition stands disposed off.
