2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 394 of the Indian Penal Code.

3. The case of the prosecution is that on 21.03.2024 at about 09:35 P.M., the informant was going to his house from Pupri Bazar and as he reached near kabristaan, three presons on one Apache bike tried to stop the informant. When he did not stop, the miscreants came near him, assaulted with knife due to which he fell down. When he fell down then the accused persons took away the bike and mobile and also Rs.18,000/- cash from the bag. The case was registered against unknown miscreants.

4. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.81771 of 2024(4) dt.03-03-2025 2/2 the petitioner was arrested in Sitamarhi P.S. Case No. 237 of 2024 and from his possession the mobile was recovered which was stolen from the informant. The petitioner is in custody since 10.06.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail. He submits that the petitioner is having criminal antecedent of two cases prior to this case and after this case he has been named in two more cases.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Pupri P.S. Case No. 142 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned court of Sub-divisional Judicial Magistrate, Pupri, Sitamarhi.

7. Accordingly, the present bail application stands allowed.
