Heard learned Counsel for the petitioner and learned APP for the State.

This application, for grant of anticipatory bail, arises out of Nayagaon PS case no. 45 of 2024, disclosing offences punishable under Sections 363, 365 of the Indian Penal Code.

The prosecution story, as per the First Information Report, is that on 17.06.2024, when the daughter of the informant namely Bharti Kumar went to the nearby shop for purchasing household articles, all the F.I.R. named accused persons kidnapped the daughter of the informant and forcibly taken her away.

Learned Counsel for the petitioner submits that the

No.80480 of 2024(2) dt.10-12-2024 2/3 daughter of the informant was in love relationship with the petitioner and in her statement made before the Police under Section 161 Cr.P.C., she has clearly stated that she left her house on her own volition. Learned counsel further submits that in her statement made under Section 164 Cr.P.C. before the Magistrate, the victim has clearly stated that she has left her house on her own will and now, she has solemnized marriage with the petitioner. He also submits that both parties have compromised the matter. The petitioner is having no criminal antecedent. 5.

Regard being had to the submissions made on behalf of the parties and taking into consideration the fact that the victim, in her statement made under Section 164 Cr.P.C. before the Magistrate, has clearly stated that she has solemnized marriage with the petitioner voluntarily, I am inclined to grant the privilege of anticipatory bail to the petitioner. 6.

This application is, accordingly, allowed.

Let petitioner, abovenamed, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st class, Begusarai in connection with Nayagaon PS Case No. 45 of 2024, subject
