JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-04-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 467/468/471/420/120B of the Indian Penal Code. As per the prosecution case, petitioner in connivance with other accused persons got the land of the informant transferred in the name of Preaveen Kumar Yadav by presenting some other person in place of the informant.

Learned counsel appearing for the petitioner submits that as a matter of fact petitioner is merely a scribe of the sale deed and narrated the facts in the sale deed whatever made available by the parties. Petitioner is not the beneficiary of the sale deed. Petitioner claims clean antecedent.

In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Biraul, Darbhanga in Kusheshwar Asthan Police Station Case No. 311 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
