JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-12-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 379 of the Indian Penal Code.
Petitioner is not named in the first information report and perusal of the impugned order goes to show that the petitioner was remanded in this case from Bachhawara P.S. Case No. 124 of 2018. Furthermore, the impugned order goes to show that the investigation against the petitioner has already been completed. I am pained to see the Judicial approach of learned Additional District and Sessions Judge, Begusarai. The impugned order goes to show that only one case was lodged against the petitioner and on taking note of the aforesaid facts the learned Additional District and Sessions Judge, Begusarai rejected the bail prayer of the petitioner.
