2. The petitioner seeks bail in a case registered for offence under Sections 126(2), 115, 109, 303(2), 352, 351(2), 3(5) of the B.N.S., 2023 and later on, Section 103(1) of the B.N.S., 2023 was added.
3. As per prosecution case, on 15.03.2025 at about 3 PM, the F.I.R. named accused persons including petitioner, in a drunken state, abused and assaulted husband of informant. The accused persons badly assaulted on the back of informant, as a result of which, during treatment, husband of informant died.
4. Learned counsel for the petitioner submits that as per F.I.R., it was co-accused Pintu Yadav and Ajay Yadav, who assaulted husband of informant. This petitioner is only alleged to be present at the place of occurrence and there is, absolutely, no overt act against him. Petitioner has got clean antecedent and
Patna High Court CR. MISC. No.74061 of 2025(2) dt.13-11-2025 2/2 is in custody since 23.05.2025. Chargesheet has been submitted.
5. Learned A.P.P. for the State opposes the prayer for bail.
6. Considering the aforesaid facts and circumstances as well as period of custody, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - II, Sherghati, District - Gaya in connection with Barachatti P.S.
