Petitioner seeks bail in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.

Allegation in brief is that a dead body was found by the police by the side of the road. Later, it was found that the deceased was driver of a pick-up van which was looted and the driver was killed. Police recovered the looted pick-up van from the house of Bihari Mandal. His wife Kian Devi disclosed that Akshay Mandal had brought the vehicle there and that Akshay Mandal disclosed the name of the petitioner as one of his associates. Learned counsel for the petitioner submits that only material against the petitioner is disclosure of his name by the

Patna High Court Cr.Misc. No.24337 of 2018 (2) dt.26-04-2018 2/2 co-accused Akshay Mandal, except that there is no other material against him and he has no criminal antecedent. He further submits that co-accused Mithun Mandal, having similar allegation, has been allowed bail by a Coordinate Bench of this Court vide order dated 20.02.2018 passed in Cr. Misc. No. 1967 of 2018 (Annexure-2).

Having considered the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Parbatta Police Station Case No. 89 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
