2. The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 323, 379, 307, 504, 506 and 354B/34 of the Indian Penal Code.

3. While the daughter of the informant was going to market, co-accused, Shahnawaj forcibly stopped her and forced to talk her on phone with a boy and when the same was flatly refused by the victim then after sometime all the accused persons including this petitioner in furtherance of their common intention armed with lathi-danda, iron rod and other weapons barged into the house of the informant and assaulted him and his family members.

4. It is submitted by learned counsel for the

Patna High Court CR. MISC. No.82599 of 2024(3) dt.27-02-2025 2/2 petitioner that no such occurrence as alleged ever took place. He is quite innocent and has been falsely implicated in this case. No incriminating article has been recovered from his conscious physical possession. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. The injury sustained by the victim is simple in nature. The petitioner has no criminal antecedent and has been languishing in custody since 10.08.2024.

5. Learned APP for the State opposed the bail petition.

Considering the facts aforesaid as also the fact that the allegation against the petitioner is general and omnibus in nature, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Dagarua P.S. Case No.147 of 2024.
