The petitioner is languishing in custody for the offence punishable under Section 395 of the Indian Penal Code. The F.I.R of the occurrence of dacoity is against unknown.
Submission is that petitioner is in custody since 07.09.2017. Investigation of the case is already complete. The petitioner was never put on Test Identification Parade nor anything was recovered from his possession. He has got no criminal antecedent and some other co-accused namely Gurucharan Chauhan and Binay Kumar @ Habbu Sao granted bail by different coordinate Benches of this court in Criminal Misc. Case No. 3754
Patna High Court Cr.Misc. No.24373 of 2018 (2) dt.26-04-2018 P2/ of 2018 and Cr. Misc. No. 59724 of 2017.
Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Civil Lines Gaya P.S. Case No. 309/2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
