2. The instant application has been filed for modification of the order dated 28th of July, 2023 passed by this Court in Cr. Misc. 38702 of 2023. While granting anticipatory bail to the petitioner, it has been mentioned in the order sheet that in the event of arrest or surrender before the court concerned within a period of eight weeks from the date of order, the petitioner was to be released on bail.

3. Now, the learned counsel appearing on behalf of the petitioner submits that the petitioner could not surrender before the court within the said period of eight weeks as he had been residing outside and working as a labourer in Punjab and

Patna High Court CR. MISC. No.80699 of 2023(2) dt.22-12-2023 2/2 due to non-communication of order within time, he could not surrender before the learned court below.

4. Under the circumstances, the order dated 28.7.2023 passed by this Court in Cr. Misc. 38702 of 2023 is modified and period of surrender of the petitioner is extended for further six weeks from today as prayed on behalf of the petitioner.

5. Accordingly, this modification application is allowed and the order dated 28.7.2023 is modified to the extent indicated above.
