JUSTICE ARUN KUMAR ORAL ORDER 26-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 18.12.2017, seeks bail in Hawai Adda PS Case No. 241 of 2017 registered under Sections 399, 402 of the IPC and Sections 25(1-b)A, 26 and 35 of the Arms Act. Learned Counsel for the petitioner submits that the petitioner was not apprehended on the spot rather due to enmity his name was disclosed by co-accused Pintu Kumar apprehended on the spot and one Vinay Kumar apprehended on the spot has been admitted to bail by a coordinate Bench of this Court vide Cr. Misc. No. 11151 of 2018.

Having considered the said facts and circumstances, the petitioner, namely, Banty Kumar @ Sanjeet Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Smt Tanveer Kaur, Judicial Magistrate, lst Class, Patna in connection with Hawai Adda PS Case No. 241 of 2017.
