JUSTICE ASHUTOSH KUMAR ORAL ORDER 26-04-2018 The petitioner seeks bail in anticipation of his arrest in connection with Manigachhi P.S. Case No. 14 of 2016 dated 23.01.2016 instituted for the offences under Sections 147, 148, 149, 341, 323, 307, 333, 353, 386, 379, 427, 504, 506, 120B of the Indian Penal Code and Section 3/4 of the Prevention of Damage to Public Property Act, 1984. The petitioner along with others is said to have indulged affray for the police having set free one of the accused of Manigachhi P.S. Case No. 11 of 2016 viz. Shailendra Yadav.

The learned counsel for the petitioner has submitted that petitioner and another person are witnesses in the aforesaid Manigachhi P.S. Case No. 11 of 2016 and because

Patna High Court Cr.Misc. No.21486 of 2018 (2) dt.26-04-2018 2/2 of the police setting free the accused Shailendar Yadav, the local people had become enraged and had resorted to vandalism. The petitioner, even though is a witness in the aforesaid case, has not done anything. In fact, the petitioner is about 75 years of age and is suffering from Tuberculosis. Considering the aforesaid facts as also taking into account that allegation against the petitioner is general and omnibus, let the petitioner, above named, in the event of his arrest or surrender before learned Court below within a period of four weeks from today, be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., VI, Darbhanga in connection with Manigachhi P.S. Case No. 14 of 2016.
