2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 364 of the Indian Penal Code.

3. As per prosecution case, six unknown miscreants boarded on a car and a motorcycle snatched the mobile phone of the informant and abducted Alok Kumar Jha for ransom.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is not named in the FIR. His name was surfaced during course of investigation. Th victim was recovered and his statement has been recorded u/s 164 of the Cr.P.C., in which he did not disclosed the name of the petitioner. No.79058 of 2023(3) dt.08-01-2024 2/2 that similarly situated other co-accused Ravi Kumar Rai has already been granted bail by a co-ordinate Bench of this court vide order dt. 25.8.2023 passed in Cr. Misc. No. 53393 of 2023. the petitioner has got no criminal antecedent and he is languishing in judicial custody since 3.6.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody period of the petitioner, this court is inclined to enlarge him on bail. The above named petitioner is directed to be released on bail in connection with Belhar P.S. Case No. 183 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 1st Banka.
