2. The petitioners apprehend their arrest in connection with Atri P.S. Case No. 238 of 2025, registered for the offences punishable under Sections 126(2), 115(2), 109, 303(2), 352, 351(2) and 3(5) of the BNS.

While the informant was engaged in digging of plinth for construction of his house in pursuant to the order passed by the Circle Officer, all the FIR named accused persons, including the petitioners, variously armed came there and brutally assaulted. There is specific allegation against coaccused Birenda Yadav and Anil Yadav, who have assaulted the
Patna High Court CR. MISC. No.74063 of 2025(2) dt.24-11-2025 2/3 informant by means of iron rod and lathi due to which he sustained serious injury. The accused persons also assaulted the wife of all the four brothers of the informant.

Learned Advocate for the petitioners submitted that besides the omnibus nature of allegation, there is a land disputed between the parties, which led to scuffle resulting into injuries to persons of both sides. There is counter version of the present case being Atri P.S. Case No. 239 of 2025. Moreover, even if the allegation is taken to be true for the sake of argument, the specific accusation has been levelled against co-accused Birendra Yadav and Anil Yadav, who are not before this Court. The petitioners bear fair antecedent and they undertake that they will fully cooperate in the proceeding of the court.
5. On the other hand, learned Advocate for the State vehemently opposed the bail application and submitted that the petitioners along with others have brutally assaulted the informant and other family members.
6. Having considered the submissions advanced by the learned Advocates for the respective parties and taking note of the limited accusation against the petitioners, coupled with their fair antecedent as well as the factum of case and counter case and the genesis of land dispute, let the petitioners
Patna High Court CR. MISC. No.74063 of 2025(2) dt.24-11-2025 3/3 abovenamed be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM-IV, Gayaji in connection with Atri P.S. Case No. 238 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, with the further condition that one of the bailors shall be the own/close family members of the petitioners.
