The petitioner seeks anticipatory bail in a case instituted for the offences under Sections 147, 148, 149, 341, 323, 353, 283 and 504 of the Indian Penal Code.
The police received an information that students of school of village Athar along with villagers of Athar and its supporters blocked the Darbhanga Benipur road and paralyzed the regular movement. Petitioners were identified by the
Patna High Court Cr.Misc. No.23012 of 2018 (2) dt.27-04-2018 Chaukidar. There is no specific allegation against the petitioners save and except omnibus allegation. Looking to the facts and circumstances of the case, in the event of arrest or surrender within four weeks from today, let petitioners, namely, Ram Nath Paswan @ Ram Nath Kumar Paswan, Birendra Mandal, Sumit Kumar Paswan @ Sunil Kumar, Raja Kumar @ Raja Lal Deo, Prinsh Lal Deo @ Prinsh Kumar, Dharmendra Mandal @ Dharmendra Mondal and Sanjeet Kumar @ Sujeet Kumar Lal Deo @ Sujeet Lal @ Sujeet Lal Deo, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Benipur, Darbhanga in connection with Bahera P.S. Case No.
229 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. Further condition is that whenever the police will call the petitioners for investigation or interrogation he will present himself before the police. In the event of being absent on two consecutive dates this order will be treated to have been withdrawn.
