JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-11-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 414/34 of the Indian Penal Code and Section 11(D) of Animal Cruelty Act. Petitioner is said to have been caught by informant and her supporters while some cows were being carried by the petitioner on a truck.

Submission on behalf of the petitioner is that neither informant nor any other person claims his ownership over the seized cattels and so far as offence of Animal Cruelty A ct is concerned, the same is bailable in nature. He, further, submits

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati, Gaya in connection with Sherghati (Dobhi) P. S. Case No. 358 of 2019.
