JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-12-2019 The petitioners seek bail in connection with Maharajganj P.S. Case No. 181 of 2019 which has been instituted for the offences under Sections 30(a), 36, 41(i) of the Bihar Prohibition & Excise Act, 2016. According to the accusation in the F.I.R, four persons out of whom two were motorcycle borne and two were on foot ran away on seeing the police party, leaving behind the motorcycle and a bag. No.70006 of 2019(2) dt.04-12-2019 2/3 motorcycle, twenty litres of liquor is stated to have been recovered whereas the bag which was thrown by the miscreants was found to be containing ten litres of liquor. Petitioner Nos. 1 and 3 are stated to have escaped by motorcycle whereas petitioner No. 2 escaped on foot.

Learned counsel for the petitioners has submitted that the other co-accused who is stated to have run away by seeing the police party, has been granted anticipatory bail by a co-ordinate Bench of this Court vide Cr. Misc. No. 50513 of 2019.

Considering the aforestated facts and the period of custody of the petitioners which is from 19.09.2019, the petitioners, above named, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise, Siwan in connection with Maharajganj P.S. Case No. 181

While saying so, this Court has also taken note of the clean antecedents of the petitioners.
