Petitioner seeks bail in connection with Kishanganj P.S. Case No. 122 of 2018, G.R. No. 329 of 2018 for offences punishable under Sections 392, 411 of the Indian Penal Code. The prosecution case, as lodged by the informant, is that while he along with his friend had gone to see a movie and while returning, four miscreants snatched Rs. 4030/- along with the cycle and mobile.
It has been submitted by the learned counsel for the petitioner that he is innocent, not named in the FIR and his name surfaced on the confessional statement of one Quadir Perwez before the police which has no evidentiary value in the eye of law.
Patna High Court Cr.Misc. No.28604 of 2018 (2) dt.11-05-2018 2/2 He submits that two of the co-accused have been granted the privilege of bail by this Court in Cr. Misc. No. 22546 of 2018 vide order dated 19.04.2018 and the petitioner is languishing in judicial custody since 20.02.2018.
However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj, in connection with Kishanganj P.S. Case No. 122 of 2018, G.R. No. 329 of 2018 subject to the condition that the petitioner will co-operate with the investigation/trial and will appear before the concerned police station/court as and when required.
