The petitioner has prayed for bail in a case registered for the offence punishable under sections 302/34/120B of the Indian Penal Code and section 27 of the Arms Act. Prosecution case relates to commission of murder of the informant's husband by the accused persons. Co-accused Vijay Yadav is order giver and on his order co-accused Ajay Yadav opened fire. It is further alleged that petitioner was the member of unlawful assembly.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Specific allegation of opening fire is against Ajay Yadav and not agains

Similarly situated other accused person has already been enlarged on bail by another coordinate Bench of this Court vide order dated 2.4.2019 passed in Cr. Misc. No. 20275 of 2019. petitioner is languishing in judicial custody since 11.08.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge IX, Begusarai in connection with Sahebpur Kamal P.S. Case No. 163 of 2017.
