The petitioner seeks bail in connection with Piro (Hasan Bazar) P.S. Case no. 124 of 2017 registered under Section 30(A), 56(D) of Bihar Prohibition & Excise Act-2016. 827 lts. of foreign liquor is said to have been recovered from two vehicles and several persons including the Praful Kumar were apprehended. Said Praful Kumar disclosed the name of the petitioner as liquor trader to whom he had earlier supplied the liquor.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. He has no concern either

Patna High Court Cr.Misc. No.19589 of 2018(2) dt.27-04-2018 2/2 with the seized liquor or with the vehicle in question or with any trade of liquor. He has been falsely implicated in the case at the instance of said Praful Kumar due to animosity. He was not apprehended on the spot. Though, one criminal case has been lodged against the petitioner, but he is on bail in the said case. He has been languishing in custody since 21.12.2017 and said Praful Kumar has been enlarged on bail by a co-ordinate Bench of this Court vide order dated 19.08.2017 passed in Cr. Misc. no. 38406 of 2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District and Sessions Judge-IV, Bhojpur, Ara in connection with Piro (Hasan Bazar) P.S. Case no. 124 of 2017. (Prakash Chandra Jaiswal, J) rohit/- U T
