JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 27-03-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Dholbajja (kadwa) P.S. Case No. 43 of 2022, registered for the offences punishable under Sections 186, 332, 333, 353 and 307 of the Indian Penal Code and Section 25(1-b) a, 26 and 27 of the Arms Act.

On the basis of secret information, police apprehended the petitioner, after little chase. There was exchange of firings and during course of firing, the petitioner also suffered some injury at his leg. From his possession, two pistols and cartridges were recovered.

The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.75419 of 2022(2) dt.27-03-2023 2/2 that he is innocent and has falsely been implicated in this case. Nothing incriminating was recovered from his possession. On the other hand, the learned APP has opposed the prayer for bail.

The petitioner was arrested at the spot with two pistols and cartridges being recovered from his possession. He is accused in seven cases, which show that he has strong criminal antecedents against him.

Considering the above-mentioned facts and circumstances as well as the criminal antecedents of the petitioner, I am not inclined to grant him bail, which is hereby rejected.
