2. The accused-petitioner, named in the F.I.R., is apprehending his arrest in connection with Patahi P.S. Case No. 262 of 2023 registered for the offences punishable under Sections 341, 323, 427, 436, 506 and 34 of the Indian Penal Code. He has no criminal antecedent as stated in paragraph '3' of the application.
3. Allegation against the petitioner is to commit mischief by putting dwelling unit of the informant on fire.
4. Learned counsel appearing on behalf of the petitioner submitted that allegation is available specific against co-accused Goldu Singh, who has already been arrested by police. It is submitted that allegation against this petitioner is only to supply petrol from his motorcycle. It is further submitted that petitioner
Patna High Court CR. MISC. No.79017 of 2023(3) dt.05-03-2024 2/2 is a man of clean antecedent.
5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail of the petitioner.
6. In view of the aforesaid factual submissions and by taking note of the fact that allegation of putting dwelling unit of the informant on fire is specific against one Goldu Singh, accordingly, above-named petitioner, in the event of his arrest/surrender within a period of four weeks from today, is directed to be enlarged on bail on furnishing of bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate - 1st Class, East Champaran at Motihari, in connection with Patahi P.S. Case No. 262 of 2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
