The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 341, 323, 325, 307, 379, 504, 506 and 34 of the Indian Penal Code pending in the learned court below.

Allegation against the petitioners is that they armed with lathi and khanti assaulted the informant and her family members.

Learned counsel for the petitioners submits that the petitioners are innocent and have been falsely implicated in this case. He further submits that there is case and counter case

He submits that there is specific overt act against the petitioner no.1 to assault the mother-in-law and father-in-law of the informant and there is no specific overt act against petitioner no.2. He further submits that petitioners have got no criminal antecedent as stated in para-3 of the bail application.

Learned APP for the State opposes for prayer for bail and submits that there is specific overt act against the petitioners to assault the informant and her family members. Hence, they do not deserve anticipatory bail.

Considering the facts and circumstances of the case and the fact that there is specific overt act against petitioner no.1, I am not inclined to enlarge the petitioner no.1 on bail in connection with Salaiya P.S. Case No. 48/2022. Accordingly, his prayer for anticipatory bail is hereby rejected. Considering the aforesaid facts and circumstances and the fact that there is no specific overt act against petitioner no.2, let the petitioner no.2, named above, in the event of his arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the
