JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 07-05-2018 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners seek pre-arrest bail in connection with Cheriaberiyarpur P.S. Case No.136 of 2017 registered under Sections 363, 366-A, 504 and 323 with 34 of the Indian Penal Code.
It is submitted by the learned counsel for the petitioners that the specific allegation of abduction of the daughter of the informant is against one Sushant Kumar son of the petitioners. The contention is that the petitioners have been implicated in this case only in order to put pressure upon them to compel their son Sushant Kumar with whom the minor daughter of the informant
Patna High Court Cr.Misc. No.26499 of 2018 (2) dt.07-05-2018 2/2 has eloped to produce the victim.
On the other hand, learned counsel for the State submitted that when the informant went to complain against the misdeed of the petitioners son, they abused, assaulted and threatened her of dire consequences.
Considering the submissions made above as also the fact that the specific allegation in the first information report is against co-accused Sushant Kumar, in the event of arrest or surrender in the court below within six weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Manjhaul, Begusarai in connection with Cheriabariyarpur P.S. Case No.136 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
