1. Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel appearing on behalf of the opposite party no. 2.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 323, 498A and 379/34 of the Indian Penal Code as well as Sections 3 and 4 of the Dowry Prohibition Act.

3. Learned counsel for the petitioner submits that the dispute was matrimonial and the parties on intervention of the well-wishers have resolved their dispute and the opposite party no. 2 is staying with the petitioner.

4. The said submission of the learned counsel

Patna High Court CR. MISC. No.78425 of 2023(5) dt.20-06-2024 2/2 appearing on behalf of the petitioner is not disputed by the learned counsel appearing on behalf of the opposite party no. 2 but then submits that petitioner does not allow the opposite party no. 2 to talk to her parents on which learned counsel for the petitioner submits that he does not have any objection if the opposite party no. 2 talks to her parents.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Complaint Case No. 1933 of 2022, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
