The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 392 of the Indian Penal Code.

The prosecution case as per the written report submitted by Harishchandra Prasad Yadav before the Station House Officer, Triveniganj P.S., is to the effect that the informant is driver of the vehicle of Airtel tower. On 18.06.2017 the informant was robbed of Rs.15,000/-, mobile leading to registration of the FIR against unknown. The name of the petitioner sprang up during investigation.

Patna High Court Cr.Misc. No.27241 of 2018 (2) dt.04-05-2018 It is submitted by learned counsel for the petitioner that there is no recovery from the petitioner but the impugned order suggests that processes under Sections 82 and 83 Cr.P.C. have been issued against the petitioner. Moreover, the petitioner is accused in three other cases as stated in paragraph 3 of the petition.

In the circumstances, this Court is not inclined to grant anticipatory bail to the petitioner. Let the learned Court below consider the prayer for bail of the petitioner, if he surrenders before the learned Court below within a period of six weeks from today in connection with Triveniganj P.S. Case No. 198 of 2017, pending in the Court of learned A.C.J.M. I, Supaul. Accordingly, this application is disposed of. (Dinesh Kumar Singh, J) DKS/- U T
