The petitioners apprehend their arrest in connection with Harnaut P.S. Case no. 230 of 2019, registered under Sections 447 and 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that six persons, named in the F.I.R. including the petitioners, came at the door of the informant boarding on four wheeler and started to call his mother. When informant Chhotu Kumar came out from the main gain, in the meantime, Raj Kumar Ram, younger brother of the informant fired through pistol causing injury at his neck

Patna High Court CR. MISC. No.68203 of 2019(2) dt.18-11-2019 2/2 then he fell down. Thereafter, all fled away from there boarding on four wheeler and he was rushed to PHC, Haranut. Learned counsel for the petitioners submits that it would appear from the F.I.R. that specific allegation of firing is against Raj Kumar Ram, brother of the informant, but the petitioners, who are friends of Raj Kumar Ram, have falsely been implicated in this case. The petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Harnaut P.S. Case No. 230 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
