2. The petitioners apprehend their arrest in connection with Raghopur P.S. Case No.218 of 2025 registered for the offences punishable under Sections 191(2), 126(2), 115(2), 109, 351(2) and 352 of the BNS, 2023.
3. While the son of the informant was returning to his home, in the meanwhile, the petitioners along with others surrounded him and started abusing. It is specifically alleged that while the petitioners no.1 and 2 were abusing the informant's son, in the meanwhile, the petitioner no.3 assaulted
Patna High Court CR. MISC. No.74556 of 2025(2) dt.25-11-2025 2/3 him by means of butt of the rifle. It is further alleged that upon exhortation of co-accused Dayanand Rai, co-accused Kanchan Rai jumped over the stomach of the informant's son and crushed his stomach causing tear in the intestine.

Learned Advocate for the petitioners contended that besides the fact that the alleged occurrence took place on 26.07.2025, the present FIR came to be instituted on 06.08.2025 after a delay of ten days; however, no plausible explanation has been given. Even as per the narrations made in the FIR, the allegation against the petitioners no.1 and 2 is of only abusing the informant's son whereas the petitioner no.3 is said to have assaulted him by means of butt of the rifle, but there is no corresponding injury. The injury which is attributed to Kanchan Rai has been found to be grievous in nature, who is not before this Court. The petitioners are the men of fair antecedent and they undertake that they will fully cooperate in the proceeding of the Court.
5. On the other hand, learned Advocate for the State vehemently opposed the bail application and submitted that the petitioners have actively participated and brutally assaulted the informant's son, which led to grievous injury.
6. Having considered the submissions set forth by the

No.74556 of 2025(2) dt.25-11-2025 3/3 learned Advocate for the respective parties and taking note of the delay in lodging of the FIR, coupled with the accusation led against the petitioners, besides their fair antecedent, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XV, Vaishali at Hajipur in connection with Raghopur P.S. Case No.218 of 2025, subject to the condition as laid down under Section 482(2) of the BNSS, with further condition that one of the bailors shall be the own/close family members of the petitioners.
