Petitioner, already in custody, seeks bail in connection with Falka P.S. Case No.359 of 2017, giving rise to S.T. No.69 of 2018, registered under Sections 302/34 and 120B of the Indian Penal Code.

Learned counsel for the petitioner submits that the FIR is against unknown, except the name of the petitioner transpired in the confessional statement of one Deepak Kumar Mehta, there is no other material, moreover similarly situated Nanku Muni @ Nanhaku Muni, another co-accused, was earlier admitted to bail by a co-ordinate Bench of this Court vide Cr. Misc. No.16750 of 2018 on 26.03.2018.

Having considered the aforesaid facts and

Patna High Court Cr.Misc. No.27799 of 2018(2) dt.08-05-2018 2/2 circumstances and the fact that another co-accused, similarly situated, has been admitted to bail, petitioner Ghanshyam Kumar Muni is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-I, Katihar in connection with Falka P.S. Case No.359 of 2017, giving rise to S.T. No.69 of 2018.
