08-05-2018 Heard Sri Ashok Kumar Jha, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody in Complaint Case No. C2-165 of 2018 registered for offence under Section 30(a) of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail.
At the very outset, learned counsel for the petitioner has drawn my attention to statement made in paragraph 3 of the petition to show that petitioner is having clean antecedent. He further submits that it is a peculiar case, in which, it was alleged that petitioner was apprehended while carrying about 126 liters of Nepali Saufi wine. It has been argued that it has not been indicated as to how the petitioner was carrying such
Patna High Court Cr.Misc. No.27788 of 2018(2) dt.08-05-2018 2/2 huge quantity of Nepali Saufi wine.
Be that as it may, considering the nature of accusation and clean antecedent, let the petitioner namely Md. Mustaffa @ Md. Mustufa be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge -cum-Special Judge, Excise Act, Sitamarhi in connection with Complaint Case No. C2-165 of 2018.
