Petitioner apprehends arrest in case registered for the offences punishable under Sections 304(B), 201/34 of the Indian Penal Code.
Prosecution case, in brief, is that all the F.I.R. named accused persons including this petitioner killed the daughter of the informant by pressing her neck.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. As a matter of fact, the deceased was living at her parent's house since 2018. It is next submitted that on 02.12.2018, when petitioner came to his house for lunch, he saw the deceased with one Mithalesh (brother-in-law of the
Patna High Court CR. MISC. No.74811 of 2022(3) dt.23-06-2023 2/2 deceased) in objectionable condition and he assaulted both by fists and slaps and ousted the deceased from his house. Thereafter, deceased went to her parent's house and she never returned and for that, father of the petitioner lodged a case bearing Complaint Case No. 2164 of 2018. The deceased did not die in the house of the petitioner and so he cannot be held responsible for the same.
However, learned A.P.P. for the State opposes the prayer for bail of the petitioner and submits that petitioner is husband of the deceased and the deceased died within seven years of marriage in an unnatural circumstances. Considering the aforesaid facts, prayer for anticipatory bail of the petitioner is refused. (Prabhat Kumar Singh, J) Navya/- U T
