The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 341, 324, 307, 120(B) of the Indian Penal Code and Section 27 of Arms Act.
The allegation against the petitioner is that he opened fire upon the informant due to which he sustained injuries.
It is submitted by learned counsel for the
Patna High Court CR. MISC. No.234 of 2023(2) dt.24-03-2023 2/3 petitioner that the petitioner is innocent and he has falsely been implicated in the present case. There is land dispute and case & counter case between the parties. Both parties have sustained injuries. Injury sustained by the informant is simple in nature, as opined by the doctor. Moreover, the petitioner is languishing in judicial custody since 11.10.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.
Learned APP appearing for the State has vehemently opposed the prayer for Bail.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Khodawandpur (Chhaurahi) P.S. Case No. 73 of 2020 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the
Patna High Court CR. MISC. No.234 of 2023(2) dt.24-03-2023 3/3 like amount each to the satisfaction of the learned S.D.J.M., Begusarai.
