The petitioner is languishing in custody since 23.08.2019 in a case registered for the offence punishable under Section 392 of the Indian Penal Code.

It is alleged that on robbing of the motorcycle and other articles of the informant, FIR was lodged against one Chhotu Kumar and two unknown persons. During investigation, the name of the petitioner sprang up and on his confession, the recovery of robbed motorcycle was made from one Sonu. It is submitted by learned counsel for the petitioner that neither there is any recovery from possession of the petitioner nor the petitioner has been put on T.I. Parade. A statement has been made in paragraph 3 of the petition that the petitioner is not

Learned APP submits that the recovery has been made on the statement of the petitioner.

Considering the fact that neither there is any recovery from the petitioner nor the petitioner has been put on T.I. Parade and investigation has already been concluded, coupled with the statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai P.S. Case No. 586 of 2018.
