The petitioner seeks regular bail in connection with G.O. Case No. 51/2018 for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The allegation is regarding recovery of 72 liters of illicit liquor from the premises of Durga Ashthan. The learned counsel for the petitioners submits that neither any recovery has been made from the conscious possession of the petitioner nor Durga Mandir belongs to the petitioner. It is further submitted the petitioner is having a clean antecedent and is languishing in custody since 14.03.2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail
Patna High Court Cr.Misc. No.31930 of 2018 (2) dt.31-05-2018 2/2 on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Session Judge II - cum - Special Judge, Excise Act, Madhubani in connection with G.O. Case No. 51/2018.
