2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 323, 498A, 504 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
3. By an earlier order, the matter had been sent to the Patna High Court Mediation and Conciliation Centre for resolution of disputes between the parties but the same has also failed.
4. The prosecution case is based upon a complaint filed by the opposite party no. 2 in which she has made an allegation of demand of dowry and torture. Petitioner is the husband of
Patna High Court CR. MISC. No.78943 of 2024(6) dt.05-08-2025 2/3 opposite party no.2.

Learned counsel for the petitioner submits that a love marriage had taken place between the petitioner and the opposite party no. 2 in the year 2018 and despite the fact that he has always been ready to keep the opposite party no.2 with full dignity and honour. It was the complainant who left the home in the year 2020 and it would be evident from her statement on solemn affirmation that since 15th January, 2020 she has been staying in her maternal house and there is no child out of the wedlock. The petitioner has also referred to the fact that the complainant never filed any other complaint during the intervening period and only in the year 2022 when a divorce case was filed by the petitioner on the grounds of adultery and desertion on 24.08.2022, that the present case came to be lodged by the opposite party no. 2 on 21.12.2022. It is further submitted that she has done a course of nursing and is right now working in a hospital.
6. Learned counsel for the opposite party no. 2, however, opposes the grant of anticipatory bail and supports the contentions made in the complaint.
7. In such view of the matter, let the above named petitioner, be released on bail, in the event of his arrest or

No.78943 of 2024(6) dt.05-08-2025 3/3 surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Complaint Case No. 953 of 2022, subject to the condition as laid down under Section 438 (2) of the Cr.P.C./482(2) of the B.N.S.S., and subject to the further condition that the petitioner shall cooperate in the investigation/trial.
