The petitioner seeks regular bail in connection with Sasaram (Darigaon) P.S. Case No. 1352 of 2016 arising out of S. Tr. No. 475 of 2017, for the offences punishable under Section(s) 395 IPC and 27 Arms Act.

The allegation is regarding unknown miscreant having snatched a sum of Rs.13,000/- and a mobile phone from the truck driver while he was coming on his truck from Kolkata and passing through the state of Bihar.

The learned counsel for the petitioner submits that neither any recovery has been made from the petitioner nor he has been put to test identification parade. It is further submitted that the petitioner is stated to be languishing in custody since 04.04.2017.

No.31737 of 2018 (2) dt.31-05-2018 2/2 Lastly, it is submitted that though the petitioner is an accused in four other cases but he is on bail in all the said cases, hence, the petitioner is ready to be put to any condition for grant of bail. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (Darigaon) P.S. Case No. 352 of 2016 related to S. Tr. No.475 of 2017.

In view of the fact that the petitioner is an accused in four other cases, I deem it fit and proper to direct that the petitioner shall mark his attendance before the concerned police station on every Monday of the week at 10 A.M. and co-operate in the investigation. The failure of the petitioner to mark attendance before the concerned police station as directed, on two consecutive dates would render the present order void and the petitioner shall be arrested forthwith.
