SINGH ORAL ORDER 02-12-2024 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is apprehending his arrest in a complaint case wherein cognizance has been taken for the offences punishable under Section 498(A) of the Indian Penal Code.

The accusations are of torture and assault and thereafter ousting the complainant from her matrimonial

Patna High Court CR. MISC. No.79257 of 2024(2) dt.02-12-2024 2/3 house due to non-fulfillment of dowry demand. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is husband of the complainant. For the same occurrence, after filing of the present complaint, the complainant has filed another case i.e. Gopalpur P.S. Case No. 184 of 2022 in which the petitioner was granted anticipatory bail by this Hon'ble Court vide order dated 20.02.2024 passed in Cr. Misc. No. 51225 of 2023. The petitioner is still ready for reconciliation but the complainant is not ready to reconcile the matter.

Considering the facts aforesaid, let the petitioner, above named, in the event of his arrest or surrender before learned Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class,
