JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-05-2018 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Suryapura PS case no. 24 of 2018 instituted for the offences punishable under Sections 307 and other sections of Indian Penal Code.

The allegation is regarding the accused persons having arrived at the house of the informant and assaulted the informant and his family members resulting in injuries to them. The learned counsel for the petitioner submits that the present case arises out of case and counter case and if at all, any injury has been inflicted upon the informant or his family members, the same are simple in nature. It is further submitted that

Patna High Court Cr.Misc. No.29122 of 2018 (2) dt.21-05-2018 2/2 the petitioner is innocent and the present case has arisen on account of family dispute and the petitioner is languishing in custody since 04.03.2018. It is further submitted that the petitioner is having a clean antecedent.

Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Bikramganj in connection with Suryapura PS case no. 24 of 2018.
