The petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that there is recovery of 15.900 litres of foreign liquor from the car and petitioner is the driver of the said car. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail application and he is languishing in judicial custody since 11.09.2019.

In the facts and circumstances of the case, let the petitioner, above named, be released on bail, subject to deposit

Patna High Court CR. MISC. No.72483 of 2019(2) dt.25-11-2019 2/2 of Rs. 5,000/- in the court below/Nazarat, on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ-IIcum-Special Judge, Excise Act, Samastipur in connection with Singhia Police Station Case No. 138 of 2019.

Such deposit of Rs. 5,000/- shall abide by the outcome of the pending criminal case.
