JUSTICE ARUN KUMAR ORAL ORDER 14-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 31.3.2018 seeks bail in Bakhtiyarpur PS Case No. 158 of 2018 registered under Sections 20, 22 of the NDPS Act and Sections 25(1-b)a, 26 and 35 of the Arms Act.

The allegation in brief is that the police raided the house of Happy Kumar son of Sadhu Singh, however Happy Kumar escaped away, the police apprehended Sadhu Singh, Guddu Kumar and this petitioner from his house and recovered eleven thousand rupees cash from the petitioner, some bags said to be stolen one by the accused persons and 500 grams of Ganja from the house of Sadhu Singh. Learned Counsel for the petitioner submits that the petitioner is co-villager of Sadhu Singh, only cash of eleven thousand rupees was recovered from his possession, ganja was recovered from the house of Sadhu Singh and not from the house of the petitioner and the petitioner has no criminal antecedent.

Having considered the said facts and circumstances, the petitioner, namely, Saurabh Kumar @ Bahira is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the
