The petitioner seeks bail in connection with Bagaha Patkhauli P.S. Case No. 132 of 2018 for the offences punishable under Sections 436, 506, 429/34 of the Indian Penal Code.
The allegation is regarding someone setting on fire the house of the informant and after the informant and his family members discovered that fire has been ignited in the house of the petitioner and the house was on fire, the family members had come outside the house and they found that the petitioner was in happy mood.
The learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.30382 of 2018 (2) dt.22-05-2018 2/2 petitioner is the full brother of the husband of the informant and on account of family feud, though there is no direct allegation the petitioner has been implicated falsely with malafide intention. It is further submitted that the petitioner is having a clean antecedent and he is languishing in custody since 02.04.2018. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-Ist, Bagaha, West Champaran in connection with Bagaha Patkhauli P.S. Case No. 132 of 2018.
