ANJANA MISHRA ORAL ORDER 25-11-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 07.09.2019 in connection with Excise Case No.396 of 2019 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the alleged recoveries were not from the conscious possession of the petitioner and the fermented toddy so recovered has been saddled on his shoulders. It is further submitted that the petitioner has no criminal antecedents.

Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on

Patna High Court CR. MISC. No.73304 of 2019(2) dt.25-11-2019 2/2 bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-Cum-Special Judge, Excise, Samastipur, in connection Excise Case No.396 of 2019.
