The petitioner seeks bail in a case registered under Sections 379, 411/34 of the Indian Penal Code and Sections 25(1-b)a, 26, 37(b) of the Arms Act.

Allegation is that some unknown culprits committed theft in the house of the informant.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 31.07.2019. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. There is no recovery of arms from the conscious possession of the petitioner. The petitioner is said to have been using the stolen mobile. The petitioner had no knowledge that the mobile in question is stolen

Patna High Court CR. MISC. No.68618 of 2019(2) dt.25-10-2019 2/2 property. He has been made accused due to mistake of fact. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Khagaria in connection with Parbatta P.S. case No.54 of 2019.
