The petitioner seeks regular bail in connection with Begusarai Nagar P.S. Case No. 438 of 2023 instituted for the offences punishable under Sections 20(B) (ii) (A)/22 NDPS Act. It is a case recovery of 1/2 kg. Ganja from the Pitthu bag.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further submits that the said ganja was recovered from an abandoned condition in the bus stand at passengers shed and he has no concern with the said bag. Petitioner has clean antecedent and he is in custody since 15.07.2023.

Patna High Court CR. MISC. No.79570 of 2023(2) dt.08-12-2023 2/2 Learned APP for the State opposes the prayer for bail of the petitioner.

Considering the facts and circumstances of the case and submissions of learned counsel for the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Begusarai in connection with NDPS Case No.35 of 2023 arising out of Nagar P.S.
