The petitioner apprehends his arrest in Nanpur P.S. Case No.371 of 2017 registered under Sections 147, 149, 341, 323, 498(A), 504 and 506 of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act.
The learned counsel for the petitioner submits that wife of the petitioner filed the case making allegation of demand of dowry and torture but now the case has been compromised. By Annexure-2, the husband and wife have been able to resolve their disputes and the husband and wife are living separately. The husband has already paid Rs.2,25,000/- to his wife and only thereafter, the maintenance case being Maintenance Case No.27
Patna High Court CR. MISC. No.68094 of 2019(2) dt.06-11-2019 2/2 of 2018 was dismissed on 20.02.2019.
Taking into consideration the fact that husband and wife have already amicably resolved their disputes, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Pupri at Sitamarhi in connection with Nanpur P.S. Case No.371 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Saurabh/- U T
